General Terms and Conditions of Sale<\/b><\/p>\n

The present General Terms and Conditions of Sale of Von der Wyestin as the seller and you as the customer apply to all orders placed in the Von der Wyestin online store (www.vonderwyestin.com)\u00a0as well as to purchases for which Von der Wyestin declares that these General Terms and Conditions of Sale are applicable.<\/p>\n

Scope of Application<\/b><\/p>\n

The GTC apply to all services provided by Von der Wyestin in the online store (www.vonderwyestin.com)\u00a0and become valid upon the conclusion of a contract. Deliveries, services, and offers from Von der Wyestin are exclusively based on these GTC, even if they are not expressly agreed upon again. By placing an order with Von der Wyestin, you confirm that you have read these GTC and expressly accept them.<\/p>\n

Conclusion of a Contract<\/b><\/p>\n

All information about goods and prices in the ordering process is non-binding. Orders are binding for customers and cannot be modified or canceled. Customers receive a non-binding order confirmation from the seller. Before the shipping notification, which constitutes the contract with the seller, Von der Wyestin may cancel its offer without issue. By placing your order, you confirm that you are aware of the scope and content of your order. Any questions in this regard should be clarified with us in advance.<\/p>\n

Delivery<\/b><\/p>\n

Goods are generally delivered by post or courier. In Switzerland, the delivery time is typically 1 to 5 business days, unless otherwise stated on the product. These details are provided without guarantee. If the sender provides an incorrect address or one where the post cannot locate the recipient, the return shipping costs charged by the post must be borne by the buyer. Once the goods are handed over to the post, Von der Wyestin assumes no further liability and does not bear the transport risk.<\/p>\n

If an item is exceptionally unavailable, we will inform you as soon as possible via email. Von der Wyestin reserves the right to make partial deliveries if it seems beneficial for efficient order processing. In such cases, no additional shipping costs will be charged for subsequent deliveries. Von der Wyestin also reserves the right to require full prepayment for international deliveries.<\/p>\n

Prices<\/b><\/p>\n

All prices on vonderwyestin\u00a0include the legal VAT in Switzerland (currently 8.1%) and exclude shipping costs. The actual shipping costs are displayed in the cart before the order is finalized. Von der Wyestin expressly reserves the right to adjust the prices listed online at any time without prior notice or explanation. The price at the time of order placement is decisive.<\/p>\n

Shipping Costs<\/b><\/p>\n

Shipping costs are calculated based on the current Swiss Post rates: http:\/\/www.post.ch\/<\/a> Additionally, all incurred packaging costs apply.<\/p>\n

Payment Terms<\/b><\/p>\n

You can choose from the following payment methods:<\/p>\n

PayPal,\u00a0<\/span>Credit card (via SumUp), w<\/span>e also reserve the right to offer prepayment by bank transfer. For prepayment by bank transfer, the payment period is generally 7 days. If payment is not received within this period, Von der Wyestin reserves the right to cancel the order and put the goods back on sale. Any transfer fees are at your expense.<\/span><\/p>\n

Retention of Title; Offsetting; Right of Retention<\/b><\/p>\n

For consumers, we reserve ownership of the purchased item until full payment of the invoice amount. If you are an entrepreneur conducting professional or independent business activity, a legal entity under public law, or a special fund under public law, we reserve ownership of the purchased item until all outstanding claims from the business relationship with the buyer are settled. The corresponding security rights are transferable to third parties.<\/span><\/p>\n

You are entitled to offset only if your counterclaims have been legally established, are undisputed, or recognized by us. Additionally, you are entitled to a right of retention only if and insofar as your counterclaim is based on the same contractual relationship.<\/span><\/p>\n

If the customer is in default of payment obligations to us, all existing claims become immediately due.<\/span><\/p>\n

Warranty and Insurance<\/b><\/p>\n

The warranty for goods complies with general standards and is 24 months unless a longer or shorter warranty period is expressly stated on the delivered goods. Defective goods must be reported in writing to the company address within 10 days of delivery or damage occurrence, otherwise, the warranty does not apply. The warranty starts from the delivery date. It expires in case of improper use or natural wear and tear. The bag must not be loaded with more than 5 kg. Von der Wyestin reserves the right to make an individual decision regarding warranty cases. Warranty and guarantee are excluded for items marked as Outlet-Ware.<\/p>\n

Return Policy<\/b><\/p>\n

Each buyer has the right to return received items to Von der Wyestin within 20 days. Returned items must be in impeccable hygienic condition, otherwise, the right to return expires. In case of return, shipping costs incurred by Von der Wyestin will be charged to the buyer or deducted from the refund amount. Return shipping costs are the buyer’s responsibility. By accepting the General Terms and Conditions, you also automatically accept our return policy.<\/p>\n

Minor Model Variations<\/b><\/p>\n

Occasionally, the design of certain items may change slightly. By nature, Von der Wyestin cannot assume responsibility for such modifications by manufacturers and suppliers.<\/p>\n

Care\/Handling<\/b><\/p>\n

Von der Wyestin disclaims all liability for improper handling or maintenance of delivered items.<\/p>\n

Tree Planting Initiative<\/b><\/p>\n

For almost every product, we plant a tree. Each month, a sum is donated to OneTreePlanted and possibly other tree-planting partners. The tree is generally planted where it is most needed at a given time. Therefore, the buyer’s tree will be planted where OneTreePlanted or another tree-planting partner organizes its next planting action.<\/p>\n

Data Protection<\/b><\/p>\n

Von der Wyestin is committed to handling customer data carefully and complying with applicable data protection laws. No data is transmitted to third parties. However, no responsibility can be assumed for the security of data transmitted over the Internet.<\/p>\n

Marketing<\/b><\/p>\n

Von der Wyestin reserves the right to reuse the email address and phone number provided during ordering for its own marketing purposes (newsletter & others). You can opt out of this process by sending a personal email to Von der Wyestin.<\/p>\n

Product Reviews<\/b><\/p>\n

\u00a0Von der Wyestin sends automated emails after purchase, inviting customers to review purchased products. Von der Wyestin reserves the right to use these reviews for marketing purposes.<\/p>\n

Gift Vouchers<\/b><\/p>\n

Personal vouchers created for a specific individual or group cannot be transferred and may only be used by authorized persons. Von der Wyestin reserves the right to cancel unauthorized orders without comment. Only one discount code can be used per order.<\/p>\n

General Liability<\/b><\/p>\n

No liability claims can be made against Von der Wyestin for direct or indirect damages unless there is intentional misconduct or gross negligence by Von der Wyestin. For example, damages resulting from accidents, falls, etc., related to handling Von der Wyestin products (bags, etc.) are the customer\u2019s responsibility.<\/p>\n

Modification of Terms and Conditions<\/b><\/p>\n

Von der Wyestin expressly reserves the right to unilaterally modify these GTC at any time without prior notice.<\/p>\n

Applicable Law\/Jurisdiction<\/b><\/p>\n

The relationship between you and Von der Wyestin is subject to Swiss law according to the provisions of the Swiss Code of Obligations (CO) and the Swiss Civil Code (CC). The place of jurisdiction is Switzerland. The application of the Vienna Convention on Contracts for the International Sale of Goods is expressly excluded.<\/p>\n

Severability Clause<\/b><\/p>\n

If any provision of this agreement is found to be invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a new provision that is as close as possible to the intended purpose.<\/p>\n
